Can a Creditor Garnish an Independent Contractor in Illinois?

I am often asked: "I’m a 1099 independent contractor, so a creditor can't garnish my wages, right?" It sounds logical, but no. While creditors can't use a traditional W-2 wage deduction against you, they have other legal tools that are often much more damaging to freelancers, gig workers, and contractors.

Why Don't Independent Contractors Get Protection?

Under federal and Illinois laws, "wage garnishment" protections are explicitly written to protect wages—which are legally defined as compensation paid by an employer to an employee.

  • The Employee Shield: Traditional W-2 employees are protected by caps that limit standard garnishments to a maximum of 15% of their paycheck, leaving them with a guaranteed baseline to live on.

  • The Contractor Vulnerability: If you are a 1099 contractor, you do not have an "employer" in the eyes of the court. You have a client or a hiring company. The money they owe you is legally classified as business accounts receivable or contract payments, not personal wages—sorry.

In Illinois, instead of a wage garnishment, a creditor will use a Non-Wage Garnishment or a Third-Party Citation. They serve this directly to the company that pays you for your contract work. Because you aren't an employee, the company is forced to freeze and turn over any outstanding invoices or payments they owe you. You lose the standard 15% cap that protects W-2 employees, meaning a creditor can legally intercept 100% of a pending contract payment.
